Marsy’s Law Representation And Counsel
Traditionally, criminal matters have been seen from the perspective of the state vs. the accused. The state represents all the people of the state and the state prosecutes the accused for their violation of the criminal code, and the defense defends the accused.
What’s Missing?
In this equation, the victim or their family may play little part. If the case involved the death of the victim, their family may be almost entirely absent from the prosecution’s case. For the individual or their family, the crime may be the most traumatic event they will experience, yet they can be left feeling as if justice for them is an afterthought.
Marsy’s Law: Justice For Crime Victims And Their Families
The criminal justice system is complex. For prosecutors, for defendants and for victims and their families. The challenge has been that the first two parties are typically represented by attorneys. The third has not.
Constitutional Rights For Victims
In California, with the passage of Marsy’s Law in 2008, that has changed. Crime victims and their families are now entitled to specific Constitutional rights to protect their safety, privacy, dignity and obtain genuine justice from the system and the perpetrator.
Three Decades Of Experience
At Law Office of Richard Welsh, I’m attorney Rick Welsh, and I provide a way forward in the criminal justice system for crime victims and their families. I have three decades of experience as a prosecutor and now use that experience to advise crime victims of their rights under Marsy’s Law, enabling them to obtain justice within that complex system.
The system is often not helpful. Legal statutes and court rulings can often leave you thinking “What does that mean?” That’s where I can help, I can help you understand what it all means and, as important, what you can do to obtain justice from that obscurity and complexity.
Every Case Is Different
It’s a commonplace saying, but it’s true. Every case is different. But with my decades of experience in the system, I can help you navigate the complexities. I will sit down with you, listen to what happened, and begin the path to move you to real justice, regardless of the challenges. I can help.
